These terms are for personal commission work only. Please contact me directly for commercial commission work. These terms are subject to change without notice at any time.


COPYRIGHT

In accordance with copyright law, all artwork created belongs solely to the artist. The only exception is given in the case of an explicit written and signed agreement to hand over rights to another party. You will not own the copyrights to any artwork created, and that these commissions are to be used by you for personal, non-profit use only.

As the artist, I retain the rights to exhibit works in personal or promotional venues both online and elsewhere such as on my website (adrawer4ever.com) and social media (Instagram, Twitter, Facebook, Tumblr, etc.) unless you expressly state that you do not want it posted. I reserve the right to include and display all work in my personal portfolio without exception. Commissions will be included in my Patreon rewards and my Gumroad packs, unless you expressly state you do not wish them to be included. I also retain the right to reproduce prints of my work to sell (pieces will likely be edited to remove any distinguishing features of an original character) and place images on print on demand sites (Society6 and Redbubble) unless you expressly state you would not like me to reproduce it.

You, as the client, retain all applicable rights to your original characters and concepts. You are NOT purchasing the publication rights to the image; works are not to be reproduced en mass (as in prints, buttons or the like) or used for profit or charity fundraising. If I find you are using my work commercially without my permission, I reserve the right and use of my work. Commercial uses include logos, anything for a corporate entity (as in not an individual), website graphics, packaging art, advertisements, etc. Depending on the situation, legal action against you may be taken. Please contact me for my policies and a price quote if you are interested in the commercial rights to your commission.


I give consent for clients to post commissions to social media so long as I am given proper credit and a link back to my social media page or website. If you plan on posting your commission publicly elsewhere online you must obtain my permission first, and the publicized piece must be credited back to me. YOU ARE NOT TO CLAIM AUTHORSHIP OF ARTWORK.

PAYMENT

All payments will be handled up front for new clients. Preferred payment is PayPal, but the following forms of payment are also accepted: credit cards/Visa debit cards via Square, Venmo, and payments in cash at a convention.


COMPLETION

As a freelancer with multiple clients and events, my schedule is varied and unpredictable. Typically I am able to turn around personal commissions within 2-3 weeks of payment received. For digital, this means you will receive the file in an email at that time. For traditional this means you will receive a photo of the work, and the work will be in the mail within 2-3 weeks. I’ll communicate early and often in the event of any delays.

REVISIONS

Commissions include one minor (design details, color edits) upon delivery. I typically do not send sketches or in progress work unless there is a delay happening to check-in with the client. If you have a specific pose, reference, or other details in mind, please do your best to outline those during initial communication to ensure the best outcome.

Major revisions will incur a 30% charge and a 10% charge each minor revision beyond those allocated above. In the case of a dispute over revisions at the finished stage, no refund will be given.

DELIVERY

For traditional art, the client is entitled to pick up all traditional artwork at an event I am attending (for free) have or have it shipped out to them (for an additional cost). All traditional artwork is mailed USPS unless you wish to purchase tracking or pay for another carrier (please specify). I am not responsible for any items/money lost in the mail. If the client chooses to forgo either option, the original will be available for sale to others online and at conventions. For an email of your traditional artwork, I will scan, clean up, and optimize your commission art for a $15 fee. This will include two .JPEG files: a hi-resolution, and optimized for web file.


For digital art, the client is entitled to a copy of the artwork, .JPEG, or .PNG file only. No .PSDs or other raw files will be sent out. Procreate and .PSD files may be purchase for an additional for 50% of the cost of your commission. Layers may be removed or flattened to protect proprietary properties (licensed typefaces, textures, etc).

AVAILABILITY & RUSH FEES

If a commission is time sensitive as in the case of art intended as gifts for occasions, please contact me within a timely manner (1-2 months before the hard deadline) to check on my availability and ensure timely delivery. I can typically work with clients to ensure the work is delivered on time.

During HOLIDAYS (particularly Christmas and Valentines) and peak convention season (July-August) my availability often becomes stretched particularly thin, so please be aware of potential delays. If you would like to be bumped to the top of my queue, I will add an additional rush fee. Occasionally I take classes as part of on-going professional and career development, during these times I may also have limited availability and may be slower to respond due to the heavier work-load. I will do my best to communicate early and often in these cases but please be patient as it will result in my craft improving and a better end product for you!

REFUNDS

I reserve the right to refuse any commission request, for any reason. I reserve the right to stop work on any commission, for any reason, at any time. If I decline to work on a commission after payment has been received, the client will be refunded in full. Once work has begun, I reserve the right to stop working and issue a partial refund. The client may also request a partial refund for in progress commissions. Full refunds are only issued at the discretion of the artist.


If a client has not responded to emails or direct messages on other platforms in over 365 days, and has no receipts that they emailed or direct messaged me and I did not receive them due to technical issues, the commission is considered forfeit. No refunds or credits will be given. Past the 365 days, the client may request a copy of the last stage of completion of a commission. They may also request the commission to be completed by paying the difference between the current stage and the desired level of completion.
